Gas Licence

Any person who carry out the following activities shall apply for a gas license from Energy Commission:

a)  gas import into regasification terminal;
b)  regasification of gas;
c)  shipping of gas;
d)  transportation of gas;
e)  distribution of gas;
f)  retail of gas; or
g) use of gas.

Gas import to the regasification terminal is the activity of bringing or causing to be brought liquefied natural gas into or within Malaysia by any means other than by transhipment.

Regasification is the activity of operating and maintaining a regasification terminal to regasify the liquefied natural gas into natural gas carried out by the regasification licensee at the regasification terminal and includes receiving, storing and after regasification, delivering the gas through the regasification terminal pipeline.

Shipping of gas is the activity of a shipping licensee making an arrangement with the regasification, transportation or distribution licensee for gas to be processed or delivered through a regasification terminal, transmission pipeline or distribution pipeline to consumers’ premises.

Transportation of gas is the activity carried out by a transportation licensee for the delivery of gas through the transmission pipeline under an arrangement with a shipping licensee.

Distribution activity is the activity carried out by a distribution licensee to operate and maintain the distribution pipeline to deliver gas through the distribution pipeline.

Retail activity is the activity of sale or use of gas through the retail licensee’s piping system to consumers’ premises where the gas is either -

a)  received from a storage tank or cylinder on the retail licensee’s own property or premises of on the property or premises of the owner or occupier; or
b)  received through distribution pipelines.

Use of gas activity is the activity of using gas as a private gas licensee.

Gas Import to Regasification Terminal License Companies who carried out activity of bringing or causing to be brought LNG to regasification terminal.
Regasification License Owner of regasification terminal facilities.
Shipping License Companies who process and transport gas through Regasification Terminal, transmission pipeline or distribution pipeline.
Transportation License Owner of transmission pipeline
Distribution License Owner of distribution pipeline
Retail License Owner of piping system
Private Gas License Owner of piping system

Applications for gas license can be made through the online system through oas.st.gov.my
Applicants need to select JGL Form: Gas License Application and select the type of license the applicant would like to apply.

The rate of license fee is as specified in Part I, Third Schedule, Gas Supply Regulations 1997 as follows;

Payment need to be made through online system via OAS-Online Application System.

Renewal of gas license shall be made at the designated time of not less than two months before the date of expiry of the license. License renewal can be made through the online system oas.st.gov.my. The applicant must select the JGL form: Gas License Application, select 'Renewal' and select the type of license to renew.

The piping system shall be maintained in accordance with the schedule as below:

Sector Maintenance Period
Commercial Sector Once every 2 years
Domestic Sector Once every 3 years

Nota:
1. Commercial sector consists of shopping malls, hotels, resorts, clubs, restaurants, educational institutes, office buildings, laundry. 
2. Domestic sector consists of condominium, apartment and residential houses.

Yes. The piping system shall be maintained in good and efficient working order to ensure the safety of persons and safety shall be observed at all times to prevent the danger from arising. Responsible person is responsible to ensure the safety standards required are complied.

The registered gas contractors shall be appointed for the purpose of maintaining the system and checking and testing should be certified by appropriate competent persons.

Yes. The gas license granted may be suspended or revoked by Energy Commission if;
a)  the gas installation is no longer to be used;
b)  the installation is found to be unsafe for use; or
c)  the holder of the license has failed to comply with the Gas Supply Regulations 1997.

Yes, any condominium or apartment premises that conduct a sale or use of gas through a piping system where gas sources are received from a storage tank or cylinder or from the distribution pipeline shall apply for the gas retailing license.

For condominium or apartment premises acquired by the management corporation, gas license applications must be made by the management corporation that registered under the Strata Titles Act 1985.

For condominium or apartment premises which is not yet taken over by the management corporation, gas license applications must be made by the developer.
